Abstract : This Chapter is about the intent and motives that propel a person to indulge in a criminal activity are the centre of the study of criminology. The nature of this intent and motive or the ability of its formation as such, is often not in question and a trial conducted for deciding the culpability of that person. However, it is pertinent to note that the ability of an offender or accused; affected by neurological and psychological limitations; to form black and white motives and intentions is debatable. While investigating a crime or case, which involves a person with history of mental illness invites several grey areas i.e. points to be examined which requires the opinion or intervention of experts in that particular field i.e. forensic psychiatry. Forensic Psychiatry or psychology is an emerging field in India what usually hears while speaking to professionals who deal with criminology. Much like forensic science, forensic psychiatry also plays an important and integral part in decoding crime. The origin of forensic psychiatry in India dates back to the drafting of Indian Penal Code by Lord Macaulay during 19th century. Section 84 of Indian Penal Code in which Mc Naughten’s rules were incorporated1.
